General terms and conditions of business
§1 Scope
(1) These General Terms and Conditions (GTC) apply to all orders placed via the online shop “Schwarzwald Erlebnisbox” by consumers within the meaning of § 13 BGB.
(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor independent professional activity.
(3) Sales are made exclusively within Germany.
(4) Any terms and conditions of the customer that deviate from these will not be recognized unless we expressly agree to their validity in writing.
§2 Offer, conclusion of contract and youth protection
(1) The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.
(2) By clicking the order button, the customer submits a binding offer to conclude a purchase agreement.
(3) The contract is concluded by our express order confirmation via e-mail.
(4) Age restriction (protection of minors): The sale of alcoholic products is restricted to persons who have reached the age of 18.
(5) By placing an order for an alcoholic Black Forest Experience Box (e.g. Black Forest Experience Box - Premium), the customer confirms that he or she is at least 18 years old.
(6) We conduct age verification. Delivery is made exclusively using a shipping service provider that verifies age upon delivery (ID or age verification). If age verification is unsuccessful, the goods will not be handed over. In this case, we reserve the right to withdraw from the contract.
§3 Prices and Payment Terms
(1) All prices include statutory VAT.
(2) In addition to the prices quoted, shipping costs will be charged, which will be shown separately during the ordering process.
(3) Payment can be made by:
PayPal
credit card
Advance payment (bank transfer)
(4) If the payment method "prepayment" is selected, the invoice amount must be transferred within 7 days.
§4 Delivery and Shipping
(1) Delivery is only available within Germany.
(2) Delivery time is usually 5-7 working days after receipt of payment, unless otherwise stated.
(3) Subscriptions will be sent on the announced monthly shipping date.
(4) If a product is unavailable, we reserve the right to replace the item with another comparable item or to withdraw from the contract. Any payments already made will be refunded immediately.
(5) The delivery of alcoholic Black Forest Experience Boxes will only take place to persons of legal age after successful age verification by the delivery person.
§5 Subscription (cancellable monthly)
(1) The Black Forest Experience Box can be obtained as part of a subscription.
(2) The subscription will be concluded for an indefinite period.
(3) The customer may cancel the subscription monthly with 7 days' notice before the next delivery date. If cancellation is not received in due time, the next delivery will still be made and the subscription will only end after this delivery.
(4) Termination is possible:
- via the cancellation function provided in the customer account (cancellation button pursuant to Section 312k of the German Civil Code),
- or in text form (e.g. via email).
(5) If no notice of termination is given in due time, the subscription will automatically be extended for another month.
(6) The right to extraordinary termination for good cause remains unaffected.
§6 Retention of Title
The goods remain our property until full payment is received.
§7 Vouchers and discount promotions
(1) Vouchers and discount codes are only valid during the period specified.
(2) Cash payment is excluded.
(3) Vouchers and discount codes can each only be redeemed once.
§8 Cancellation Policy
Right of withdrawal
Consumers have the right to withdraw from this contract within fourteen days without giving any reason.
The cancellation period is fourteen days from the day on which the consumer or a third party named by him, who is not the carrier, has taken possession of the goods.
To exercise the right of withdrawal, the consumer must inform us, Schwarzwald Erlebnisbox, August-Hund-Str. 8, 77656 Offenburg, info@schwarzwald-erlebnisbox.de, of his or her decision by means of a clear statement (e.g. by email or letter).
To meet the cancellation deadline, it is sufficient to send the cancellation notice in a timely manner.
Consequences of the revocation
In the event of a cancellation, we will refund all payments received, including standard delivery costs, immediately and at the latest within fourteen days of receiving the cancellation notice.
For refunds, we will use the same payment method as for the original transaction, unless otherwise agreed.
We may refuse to refund the goods until we have received them back or the consumer has provided proof that they have returned the goods.
The consumer bears the direct costs of the return shipment.
Exclusion of the right of withdrawal
The right of withdrawal does not apply in the following cases:
- sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery,
- Goods that can spoil quickly or whose expiration date would be quickly exceeded,
- individually assembled or personalized goods.
- The right of withdrawal may be excluded for food products or beverages that have already been opened or unsealed.
§9 Liability
(1) We shall be liable without limitation in cases of intent and gross negligence as well as in cases of damage resulting from injury to life, body or health.
(2) In the case of slight negligence in the breach of essential contractual obligations, liability shall be limited to the foreseeable damage typical for this type of contract.
(3) Otherwise, liability is excluded.
§10 Dispute Resolution
The EU Commission provides a platform for online dispute resolution (ODR). We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
